HB18-1077: PENALTY FOR BURGLARY OF FIREARMS

In current law, second degree burglary is a class 4 felony, but it is a class 3 felony under 2 circumstances. The bill designates a third type of second degree burglary as a class 3 felony; that is, a burglary, the objective of which is the theft of one or more firearms, firearm parts, firearm accessories, or ammunition. The bill also states that when a person is convicted of such a burglary, in addition to any other sentence, the court may require the person to pay a fine of at least $10,000 but not exceeding $750,000.

HB18-1228 TRANSPARENCY IN MILITARY HIGHER EDUCATION STATUTES

The bill creates a new article 7.4 in title 23, Colorado Revised Statutes, with the article heading "Military Members, Veterans, and Dependents", in order to locate physically within the same article, whenever practicable, higher education provisions relating to the military. Part 1 of article 7.4 includes general provisions, including cross references to provisions relating to the military in other articles of title 23. Part 2 of article 7.4 includes relocated provisions from article 7 of title 23 relating to in-state tuition classification relating to the military. Part 3 of article 7.4 includes a relocated provision relating to financial assistance for Colorado National Guardsmen and a cross reference to financial assistance programs in another article of title 23. The bill repeals the provisions that have been relocated to article 7.4 of title 23.

HB18-1281: PUBLIC UTILITIES COMMISSION ETHICS AND IMPROVED PUBLIC INFORMATION REPORTING

Section 2 of the bill prohibits a person from serving on the public utilities commission if he or she: Has, within the immediately preceding 4 years, served as an officer or director of a regulated utility; or Has or acquires any official relation to, or financial interest in, a regulated utility. Section 3 encourages the director of the commission to assign employees to temporary training and development sessions with other state agencies, particularly those with which the commission has frequent interaction, to improve the employees' substantive expertise and familiarity with the operations of those agencies. Section 3 also requires the director to keep written and audio records of the commission's proceedings and make them publicly available online. In addition, section 3 expressly authorizes the executive director of the department of regulatory agencies (of which the commission is a part) to request that the state auditor conduct performance audits of the commission and its staff and operations. Section 4 directs the commission to adopt rules concerning conflicts of interest, incompatible activities, and ex parte communications

HB18-1351: SIGNAGE FOR OLD SPANISH NATIONAL HISTORIC TRAIL

Section 1 of the bill recognizes the significance of the old Spanish national historic trail as a historic resource in Colorado. The bill requires the executive director of the department of transportation to erect signs marking portions of the trail that travel along or cross highways in Colorado. Section 2 amends existing law that makes it a misdemeanor to deface or destroy monuments or markers on the Santa Fe trail to include monuments marking any historic trail.

HB18-1423: RURAL FIRE PROTECTION DISTRICT EQUIPMENT GRANTS

The division of fire prevention and control in the department of public safety is currently authorized to use money in the local firefighter safety and disease prevention fund to provide grants for equipment and training to increase firefighter safety and prevent occupation-related diseases. The bill specifies that the fund may also be used to assist rural special fire protection districts in replacing or refurbishing equipment and transfers $500,000 from the general fund to be used for this purpose.

SB18-020: REGISTERED PSYCHOTHERAPISTS AURICULAR ACUDETOX

Current law allows licensed mental health care professionals and level III certified addiction counselors who have documented that they have undergone auricular acudetox training to perform auricular acudetox. The bill allows registered psychotherapists who have documented that they have undergone the same training requirements to also perform auricular acudetox.

SB18-029: DEVELOPMENT OF MARIJUANA TRACKING TECHNOLOGY

The bill requires the institute of cannabis research at Colorado state university - Pueblo (institute) to develop marijuana tracking technology (technology). The technology must include an agent that is applied to a marijuana plant, marijuana product, industrial hemp, or industrial hemp product and then scanned by a device. The scan, at a minimum, would indicate whether the marijuana or hemp was cultivated, manufactured, or sold by a licensed marijuana business or registered hemp cultivator. The institute shall select a vendor to develop the technology. After the technology is developed, the state licensing authority must be satisfied that the technology provides an effective means of tracking marijuana. After the state licensing authority determines the technology is an effective means of tracking marijuana, it shall promulgate rules that require the technology to be used by licensed marijuana businesses, and the commissioner of the department of agriculture shall promulgate rules that require registered industrial hemp cultivators to use the technology. The technology that scans the marijuana must be made available to law enforcement and the department of revenue. The bill clarifies that the gray and black market marijuana enforcement grant program could award grants to law enforcement agencies to purchase the marijuana scanning technology.

SB18-066: EXTEND OPERATION OF STATE LOTTERY DIVISION

The bill repeals the scheduled termination on July 1, 2024, of the state lottery division (division) in the department of revenue, the effect of which is to permanently establish the division.

SB18-081: EMERGENCY MEDICAL SERVICE PROVIDERS LICENSING

Currently, regulation of an emergency medical service provider, including a paramedic, is referred to as certification. Section 1 of the bill changes "certification" references to "licensure". Section 2 requires an emergency medical service provider applying for a new license or renewing, reinstating, or reactivating a license to comply with the "Michael Skilnik Medical Transparency Act of 2010".
